ARTICLE 1 - Scope

These Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by Dumaine Clément (“the Seller”), publisher of Maison Alméa, with consumers and non-professional buyers (“the Customers” or “the Customer”) wishing to purchase the products offered for sale (“the Products”) on the website maisonalmea.uk. They set out in particular the conditions for ordering, payment, delivery and handling any returns of Products ordered by Customers. They are available at all times on the website and shall prevail, where applicable, over any other version or any other conflicting document. The version applicable to the Customer's purchase is the one in force on the website on the date the order is placed.

ARTICLE 2 - Products offered for sale

The Products offered for sale on the website maisonalmea.uk are as follows: Wall lights and Pendant lights. The main characteristics of the Products, including specifications, illustrations and dimensions, are presented on the website. The Customer must read them before placing any order. The photographs and graphics shown are not contractual and cannot give rise to any liability on the part of the Seller. Contractual information is provided in French.

ARTICLE 3 - Validity of the Product offer

Product offers are valid while stocks last, as indicated when the order is placed.

ARTICLE 5 - Orders

5-1. Placing an order. It is up to the Customer to select on the website the Products they wish to order. The Customer can check the details of their order and its total price, and correct any errors before confirming their acceptance. An order is registered when the Customer accepts these Terms by ticking the box provided for this purpose and confirms their order. The sale is only final once the Seller has sent the Customer confirmation of acceptance of the order by email and the full price has been received. The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute concerning payment for a previous order. The Seller does not intend to sell the Products to professionals and reserves the right to refuse orders for large quantities of the same Product.

5-2. Changing an order. Any changes to the order by the Customer can only be taken into account within the limits of the Seller's possibilities and provided they are notified by email to contact@maisonalmea.uk at least 4 days before the scheduled dispatch date. Otherwise, the sums paid will be refunded within a maximum of 14 days.

5-3. Cancelling an order. Orders may be cancelled by the Customer free of charge, other than when exercising the right of withdrawal or in cases of force majeure, at least 2 days before the scheduled dispatch date.

ARTICLE 6 - Prices

The Products are supplied at the prices in force shown on the website maisonalmea.uk when the order is registered. Prices are expressed in pounds sterling (£) and include all taxes and customs duties: the Customer has nothing to pay on delivery. These prices are firm and not subject to revision during their period of validity. Delivery is free for orders delivered in the United Kingdom.

ARTICLE 7 - Payment terms

The price is payable in full on the day the order is placed, by secure payment: bank cards (Visa, Mastercard, American Express, Cartes Bancaires), PayPal, Apple Pay, Shop Pay and Klarna. Payment by bank card is irrevocable, except in the event of fraudulent use of the card.

ARTICLE 8 - Deliveries

Ordered Products are delivered in the United Kingdom and are shipped from outside the United Kingdom. Products are delivered within 7 to 10 working days from order confirmation (dispatched within 24 to 48 working hours, followed by 6 to 8 working days in transit), to the address given by the Customer when ordering. If the ordered Products have not been delivered within 30 days of the estimated delivery date, for any reason other than force majeure or an act of the Customer, the Customer may cancel the sale by written request, in accordance with their statutory rights; the sums paid will be refunded no later than fourteen days afterwards. If the delivered Product does not conform, the Seller undertakes to remedy this or refund the Customer. The Seller bears the risks of transport and is required to refund the Customer for damage caused during transport.

ARTICLE 9 - Transfer of ownership - Transfer of risk

Ownership of the Products is only transferred once the Customer has paid the price in full. The risk of loss and damage is only transferred when the Customer takes physical possession of the Products. The Products therefore travel at the Seller's risk.

ARTICLE 10 - Right of withdrawal

The Customer has a statutory 14-day right to cancel. As a commercial gesture, the Seller extends this period to 90 days from receipt of the Product, without the Customer having to give reasons or pay any penalty, for the purpose of an exchange or refund. Returns must be made in their original condition and complete (packaging, accessories, instructions) so that they can be resold as new, together with the purchase invoice. Damaged, soiled or incomplete Products will not be accepted. The right of withdrawal may be exercised by email to contact@maisonalmea.uk using the withdrawal form (Appendix 2) or any other unambiguous statement. Return costs: paid by Maison Alméa (free returns for the customer). The refund, including the price of the Products purchased and the delivery costs, will be made within 14 days of the Seller being notified of the decision to withdraw.

ARTICLE 11 - Seller's liability - Guarantee

The Products sold on the website maisonalmea.uk comply with the regulations in force in France. The Products benefit by law and at no extra cost, regardless of the right of withdrawal, from: the legal guarantee of conformity, for Products that are apparently defective, spoiled, damaged or do not match the order; and the legal guarantee against hidden defects resulting from a defect in materials, design or manufacture. Under the legal guarantee of conformity, the Customer has two years from delivery of the goods to take action against the Seller; they may choose between repair or replacement of the Product, within the limits provided for by law. The Seller will refund or replace Products under guarantee found to be non-conforming or defective as soon as possible and no later than 14 days after the defect is established. The refund will be made to the original payment method. The Seller cannot be held liable in the event of misuse, professional use, negligence or lack of maintenance on the part of the Customer, nor in the event of normal wear and tear of the Product, accident or force majeure.

ARTICLE 12 - Protection of personal data

The personal data requested from the Customer is necessary to process their order and draw up invoices. It may be passed on to the Seller's partners responsible for carrying out, processing, managing and paying for orders. In accordance with the national and European regulations in force, the Customer has a permanent right of access, modification, rectification, objection, portability and restriction of processing regarding information concerning them.

ARTICLE 13 - Intellectual property

The content of the website maisonalmea.uk is the property of the Seller and its partners and is protected by French and international intellectual property laws. Any total or partial reproduction of this content is strictly prohibited.

ARTICLE 14 - Unforeseeability

These Terms expressly exclude the statutory regime of unforeseeability (imprévision) provided for in article 1195 of the French Civil Code for all sales of Products by the Seller to the Customer.

ARTICLE 15 - Force majeure

The Parties cannot be held liable if the non-performance or delay in performance of any of their obligations results from a case of force majeure within the meaning of article 1218 of the French Civil Code.

ARTICLE 16 - Applicable law - Language

These Terms and the transactions arising from them are governed by French law. They are written in French. Should they be translated into one or more languages, only the French text shall prevail in the event of a dispute. This does not affect your statutory rights as a consumer.

ARTICLE 17 - Disputes

All disputes to which purchase and sale transactions concluded under these Terms may give rise, and which could not be resolved between the Seller and the Customer, will be submitted to the competent courts under ordinary law. The Customer is informed that they may in any event use conventional mediation (alternative dispute resolution). The Seller's mediator: CM2C, 14 rue Saint Jean, 75017 Paris, France, Tel: +33 1 89 47 00 14.

ARTICLE 18 - Pre-contractual information - Customer acceptance

By ordering on the website maisonalmea.uk, a natural person fully and unreservedly accepts these Terms and undertakes to pay for the Products ordered.
